Website and enquiry terms

1. Administration and scope. The service is provided by the NEOARCA website administration. The website does not currently act as seller or payment recipient. These Terms govern catalogue access, account creation and artwork enquiries.

2. Accounts and enquiries. Visitors may browse without registration. Account holders must provide accurate details and protect their credentials. An acknowledgement confirms receipt only; it does not confirm availability, price or willingness to transact.

3. No sales through the website. Checkout, payment, deposits, reservations and online sale contracts are not available. Displayed prices are indicative and are not offers capable of acceptance. An enquiry is not an order, acceptance, reservation or contract.

4. Acceptable use. Users must not interfere with security, scrape at scale, upload malicious material, impersonate another person, infringe rights or misrepresent authorship, ownership or provenance.

5. Intellectual property. The website, brand, editorial material and catalogue presentation are protected. Catalogue access does not transfer copyright or permit commercial reproduction, model training, systematic extraction or removal of attribution.

6. Artwork information and AI. Descriptions, provenance notes, price indications and editorial material are informational and may be incomplete. Internal AI-assisted analysis does not authenticate, attribute, appraise, publish or set a final price; final decisions are made by staff.

7. Personal data. Account and enquiry data is handled under the Privacy Policy. Terms acceptance, privacy acknowledgement and optional marketing consent are recorded separately.

8. Changes and contact. Material changes are published as a new dated version. Legal and privacy requests may be sent using the website contact details. Version 1.1 dated 9 August 2026.

9. Service availability. NEOARCA may perform maintenance, change or discontinue features and restrict access where necessary for security, rule enforcement or legal compliance. Continuous and error-free availability is not guaranteed.

10. Moderation and account restrictions. The administration may request supporting information, reject an enquiry, hide material or restrict an account for inaccurate information, rights violations, suspected fraud, security risk or repeated misuse. A user may challenge a restriction through the website contact.

11. No implied warranties. Unless expressly stated, catalogue information is provided as available and does not replace independent professional review. NEOARCA does not guarantee future value, liquidity, investment outcome, authenticity or provenance beyond expressly confirmed written information.

12. Liability. Nothing excludes liability that cannot lawfully be excluded. Otherwise, the administration is not responsible for indirect loss, decisions based on indicative information, user conduct or failures of third-party networks and services.

13. Applicable law. Mandatory law that cannot be excluded remains applicable. Because no selling company or payment flow is currently offered, these Terms do not govern a sale contract; any future transaction requires separate identification of the parties and terms.

14. Severability and account integrity. If one provision is unenforceable, the remainder continues. A failure to enforce a right once is not a waiver. Accounts may not be transferred to another person.

Artist submission terms

1. Applicant and eligibility. The artist confirms legal capacity, accurate identity information and authority to submit each artwork, image and item of personal data.

2. No commercial relationship. Account creation, submission, moderation or publication does not oblige NEOARCA to represent the artist, market or sell a work, maintain publication, quote a price or enter into an agreement. No commission, exclusivity, payout, insurance, custody or delivery terms arise.

3. Submission warranties. The artist confirms authorship or documented authority, lawful ownership or permission, accurate original, edition or copy labelling, known provenance and condition information, and sufficient rights in images and text.

4. Review and moderation. NEOARCA may request evidence, correct formatting, reject, hide or remove material, and investigate ownership, authenticity or rights complaints. Internal AI may support triage but cannot authenticate or make the final publication decision.

5. Publication licence. For approved material, the artist grants a non-exclusive, worldwide, royalty-free licence during publication and reasonable archival retention to host, resize, crop, watermark, translate, display and promote it. This does not authorise sale of the artwork or merchandise.

6. Personal data and public profile. Private account data is handled under the Privacy Policy. Public profile fields require separate valid publication permission where applicable. Marketing consent is optional and separate.

7. Future agreement. Any consignment, agency, licence, custody or sale arrangement requires a separate written agreement identifying the parties, work, territory, price mechanism, commission, taxes, payout, insurance and termination.

8. Contact and version. Version 1.1 dated 9 August 2026. Current contact details are published on the NEOARCA website.

9. Provenance and condition. The artist discloses known creation, ownership, exhibition, publication, restoration, damage and other facts material to the description. Unknown or unverified information must not be presented as established fact.

10. Originals, editions and copies. An original is described as a unique artist-made object unless the medium indicates otherwise. Editions identify edition size, copy number and authentication method. A quality copy is always labelled as non-original and must not create a misleading impression.

11. Complaints and cooperation. For authorship, ownership, image-right or privacy disputes, the artist provides reasonably necessary explanations and evidence. Publication may be restricted during review without implying that a violation has occurred.

12. Withdrawal of material. The artist may request removal from public display. NEOARCA may retain minimal archival records, consent logs and information needed to protect rights, investigate complaints and comply with law.

13. Applicant responsibility. The artist is responsible for the accuracy of statements and lawful submission of material. This does not remove NEOARCA's responsibility to review substantiated notices and act on sufficient information.

Gallery submission terms

1. Gallery identity and authority. The applicant provides its name, registration details where applicable, representative and contact information and warrants authority to act for the gallery and represent each identified artist, owner and artwork.

2. No commercial appointment. Account creation, review or publication does not appoint NEOARCA as agent, dealer, consignee or payment intermediary and does not create exclusivity, commission, payout, custody, insurance, delivery or sale obligations.

3. Information and rights. The gallery provides accurate authorship, ownership, provenance, condition, edition, restriction and authority information, identifies relevant rights holders and discloses liens, competing mandates and later changes.

4. Moderation and complaints. NEOARCA may request evidence, reject or remove material, suspend an enquiry and investigate complaints. Publication is discretionary. Internal AI supports triage only and does not authenticate or determine ownership.

5. Publication licence. For approved material, the gallery grants a non-exclusive, worldwide, royalty-free licence during publication and reasonable archival retention to host, resize, crop, watermark, translate, display and promote it, and warrants authority to grant that licence.

6. Enquiries. NEOARCA may forward or summarise an enquiry only under the Privacy Policy and applicable permissions. An enquiry does not create a sale, reservation, mandate or duty to transact.

7. Future agreement. Commercial cooperation requires a separate written agreement covering seller identity, authority chain, price, commission, tax, payout, custody, insurance, delivery, returns, complaints and termination.

9. Authority checks. On request, the gallery supplies registration information, representative authority, its relationship with the artist or owner and its right to use artwork images and information. Review does not create a commercial commitment.

10. Keeping information current. The gallery promptly reports withdrawn authority, an off-platform sale, changes in availability or price, new liens, disputes, export restrictions or other material developments.

11. Represented individuals. The gallery must have a lawful basis to provide data about artists, owners, staff and representatives and must give them required processing information. Public profiles of individuals require applicable permission.

12. Complaints and suspension. NEOARCA may pause publication or enquiry forwarding until sufficient evidence is received. The gallery cooperates with review and must not obstruct direct contact from a rights holder.

13. Gallery responsibility. The gallery is responsible for the accuracy of authority, rights and artwork statements. NEOARCA liability limitations do not apply where prohibited by mandatory law.

Privacy policy and consents

1. Controller and purposes. The NEOARCA website administration processes data to create and operate accounts, secure the service, answer enquiries, moderate submissions, meet legal requirements and protect rights.

2. Data categories. Data may include name or organisation, email, phone, country, role, profile information, enquiry text, uploaded material, consent records, technical events, IP address, session data and support correspondence.

3. Legal basis and user choice. Required processing is explained in the relevant form. Terms acceptance, privacy acknowledgement and optional marketing consent are presented and recorded separately.

4. Providers and international infrastructure. Hosting, database, file storage, email, analytics and support providers may process data. Infrastructure may be located outside the user's country, subject to applicable requirements.

5. Retention. Account data is kept until account deletion and afterwards for periods required for security, dispute resolution and mandatory obligations. Enquiries and correspondence are retained until completion and for the applicable internal period.

6. Security. Access is role-restricted and supported by logging, access controls and technical safeguards. Users must keep passwords confidential and report suspected unauthorised access.

7. User rights. Users may request information, access, correction, restriction or deletion and may withdraw consent where processing relies on consent. Requests may be sent to the published privacy contact; identity verification may be required.

8. Marketing and changes. Marketing email requires separate optional consent and can be withdrawn. Material changes are published as a new dated version.

9. Public profile data. Artist and representative information is published only within the selected public profile scope and as permitted by applicable law. Private contact details, financial data, identity documents and staff notes are not made public.

10. Images and documents. Uploaders must have authority to submit images and should avoid passports, financial information, bystanders and sensitive data unless strictly necessary. Original files and derived public versions have different access controls.

11. Automation and AI. AI may support internal preliminary handling of descriptions and material under staff review. It does not form contracts, authenticate artworks or receive unnecessary identity or payment information.

12. International transfers. Where data is transferred to a recipient outside the user's country, the administration must identify an applicable legal basis, recipient, purpose, data categories and required safeguards or notices.

13. EEA and UK transparency. Where GDPR or UK GDPR applies, required information includes controller identity and contact details, purposes and legal bases, recipients, transfers, retention, rights and complaint routes. Missing controller details must be completed before targeted processing that requires them.

14. Incidents and enquiries. Suspected data loss, unauthorised access or account compromise should be reported promptly. The administration records the incident, limits impact and makes legally required notifications where applicable.

Cookie policy

1. Necessary cookies support sign-in, security, sessions, language choice and essential settings. Some functions may not work without them.

2. Analytics cookies help understand use of the website and identify errors. They are not enabled before the user's choice where prior consent is required.

3. Cookies may be set by NEOARCA or connected technical providers. Session cookies expire with the session; persistent cookies remain for their stated period.

4. Users may change their choice through cookie settings and remove cookies through the browser. Removing necessary cookies may sign the user out.

5. Material changes to cookie purposes or providers are reflected in a new version of this policy.

Prices and enquiries

1. An enquiry requests information about an artwork, its availability and indicative price.

2. Submitting an enquiry and receiving a curator response does not create an order, reservation, acceptance or contract and does not guarantee availability.

3. Seller identity, final price, taxes, delivery and other possible transaction terms must be agreed separately before payment.

4. The website does not currently accept payments, deposits or reservations.

Content, intellectual property and complaints

1. Users may upload only material for which they hold the necessary rights and permissions.

2. A rights holder may submit a complaint identifying themselves, the disputed material, URL, nature of the issue and supporting evidence.

3. NEOARCA may temporarily hide material during review and request explanations and documents from the complainant and uploader.

4. Material may be restored, restricted or removed after review. Repeated or manifest infringement may result in account restrictions.
